These Terms of Service (“Terms”) govern your access to and use of www.imagin8press.com (the “Site”), operated by Imagin8 Press LLC (“Imagin8 Press,” “we,” “us,” or “our”). By accessing or using the Site, placing an order, or posting a review or comment, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on the Site or to create an account. If you are under 18, you may use the Site only with the consent of a parent or guardian.

2. Products and Purchases

a) Where You Can Buy Our Books

Books and other products may be purchased directly through the Site, or through third-party retailers we link to (such as Amazon and other booksellers). Purchases made through third-party retailers are governed by that retailer’s own terms of sale, not these Terms.

b) Pricing and Availability

We attempt to display accurate pricing and availability for items sold directly on the Site, but errors may occur. We reserve the right to correct pricing errors, cancel orders affected by such errors, and to change prices at any time without notice. If we cancel an order due to a pricing or availability error, we will notify you and issue a full refund for any amount already charged.

c) Order Acceptance

Your order is an offer to purchase. We reserve the right to accept or decline any order, or to limit order quantities, for any reason, including suspected fraud or errors in product or pricing information.

d) Payment

Payment for direct purchases is processed by our third-party payment processor(s). By providing payment information, you represent that you are authorized to use the payment method provided.

e) Shipping

We ship to addresses within the United States and internationally to countries listed on our Buy Our Books page. Shipping times, costs, and available methods will be shown at checkout. For international orders, you are responsible for any customs duties, import taxes, or other fees imposed by your country; we do not collect these fees at checkout and are not responsible for shipping delays caused by customs processing.

f) Returns and Refunds

Returns and refunds for direct purchases are handled on a case-by-case basis. If you’re not satisfied with an order, please contact us at info@imagin8press.com and we’ll work with you to find a resolution.

3. User-Generated Content (Reviews, Comments, and Similar)

The Site may allow you to post reviews, comments, ratings, or other content (“User Content”).

a) License You Grant Us

By posting User Content, you grant Imagin8 Press a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, edit, display, and distribute that content in connection with operating and promoting the Site and our books, in any media, without additional compensation to you.

b) Your Responsibilities

You are solely responsible for the User Content you post. You agree not to post content that:

• Is false, defamatory, or misleading;
• Infringes someone else’s copyright, trademark, privacy, or other rights;
• Is obscene, hateful, harassing, or otherwise objectionable;
• Contains spam, advertising, or malware;
• Violates any applicable law.

c) Our Rights

We do not necessarily review User Content before it is posted, but we reserve the right (without any obligation) to remove, edit, or refuse to post any User Content, and to suspend or terminate accounts, at our sole discretion.

d) Ownership

You retain ownership of your User Content, subject to the license granted above.

4. Intellectual Property

a) Our Content

The Site, including its text, graphics, logos, and design, and the books and other works we publish, are owned by Imagin8 Press LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. “Imagin8 Press,” the Imagin8 Press logo, and the sail image are trademarks of Imagin8 Press LLC.

b) Restrictions on Use

Except as expressly permitted (for example, normal personal reading and use of a book you’ve purchased, or brief quotation with attribution as permitted by fair use), you may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission.

Notably, no part of any Imagin8 Press book or other content on this Site may be used or reproduced in any manner for the purpose of training artificial intelligence technologies or systems, without our prior written consent.

c) Feedback

If you send us feedback or suggestions about the Site or our books, you agree that we may use that feedback without any obligation to compensate you.

5. Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose;
• Attempt to gain unauthorized access to the Site, its systems, or other users’ accounts;
• Interfere with or disrupt the Site’s operation (for example, through malware, excessive automated requests, or denial-of-service attacks);
• Scrape, harvest, or collect data from the Site using automated means without our permission;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

6. Third-Party Links

The Site may contain links to third-party websites, including retailers where our books are sold. We do not control and are not responsible for the content, policies, or practices of any third-party site. Your use of third-party sites is at your own risk and subject to their own terms.

7. Disclaimers

THE SITE AND ALL PRODUCTS AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IMAGIN8 PRESS LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

You agree to indemnify and hold harmless Imagin8 Press LLC and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms, your User Content, or your misuse of the Site.

10. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Pennsylvania, and you consent to personal jurisdiction there.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page with a revised “Last Updated” date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the Site at any time, for any reason, including violation of these Terms.
